Please read these Terms of Service ("Terms") carefully before using the Vight platform operated by Vight, Inc. ("we", "us", or "our").
1. Acceptance of Terms
By accessing or using Vight, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service. These Terms apply to all users, including organizations and their authorized members.
2. Description of Service
Vight is a call intelligence platform designed for Managed Service Providers (MSPs). Our service includes:
- AI-powered call transcription and summarization
- Integration with phone systems (3CX, MS Teams)
- Integration with PSA systems (ConnectWise)
- Automated ticket matching and time entry creation
- Notification delivery to MS Teams
- Analytics and reporting dashboards
3. Account Registration
To use Vight, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
You must be at least 18 years old and have the authority to bind your organization to these Terms.
4. Subscription and Billing
Vight offers subscription-based pricing. By subscribing, you agree to:
- Pay all fees according to your selected plan
- Provide valid payment information
- Accept automatic renewal unless cancelled before the renewal date
- Understand that fees are non-refundable except as required by law
We reserve the right to change pricing with 30 days notice. Usage-based features may incur additional charges as specified in your plan.
5. Acceptable Use
You agree not to use Vight to:
- Violate any applicable laws or regulations
- Record calls without proper consent where required by law
- Infringe on intellectual property rights
- Transmit malicious code or interfere with the service
- Attempt to gain unauthorized access to our systems
- Resell or redistribute the service without authorization
- Use the service in a manner that could harm other users
6. Call Recording Compliance
You are solely responsible for ensuring compliance with all applicable call recording laws and regulations, including but not limited to:
- Obtaining necessary consent from call participants
- Providing required disclosures about recording
- Complying with one-party or all-party consent requirements
- Adhering to industry-specific regulations (HIPAA, PCI-DSS, etc.)
Vight is a technology platform and does not provide legal advice regarding call recording compliance.
7. Your Data
You retain ownership of all data you submit to Vight ("Your Data"). By using our service, you grant us a limited license to process Your Data solely to provide the service. This includes:
- Processing call recordings through AI for transcription and summarization
- Storing data according to your configured retention settings
- Transmitting data to your connected integrations
You represent that you have all necessary rights to submit Your Data and that your use of the service complies with applicable privacy laws.
8. Intellectual Property
The Vight service, including its original content, features, and functionality, is owned by Vight, Inc. and is protected by intellectual property laws. Our trademarks and trade dress may not be used without prior written permission.
We grant you a limited, non-exclusive, non-transferable license to use the service for your internal business purposes during your subscription term.
9. Third-Party Integrations
Vight integrates with third-party services. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime or service interruptions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that AI-generated summaries or analyses will be accurate, complete, or suitable for any particular purpose. You should review all outputs before relying on them for business decisions.
13. Indemnification
You agree to indemnify and hold harmless Vight and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any applicable laws, including call recording laws
- Your Data or any content you submit
14. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the service.
You may cancel your subscription at any time through your account settings. Upon termination, your right to use the service ceases immediately. We may retain Your Data for a reasonable period to allow for data export.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes through the service or by email. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
